Blue Indigo Creative | Terms & Conditions

These Terms and Conditions apply to all services provided by Blue Indigo Creative. By booking services or submitting payment, the client agrees to the following Terms and Conditions.
Scheduling
Appointments may be requested through our online booking system, email, text, or phone. Blue Indigo Creative will make reasonable efforts to schedule sessions at optimal times based on lighting, weather, and availability.
Blue Indigo Creative reserves the right to adjust or reschedule appointments due to weather conditions, safety concerns, scheduling conflicts, or other logistical considerations. Clients will be notified via phone, text, or email if changes are required.
Property Access
Clients are responsible for ensuring access to the property at the scheduled appointment time. This includes providing lockbox codes, gate access, homeowner permission, or any required entry instructions.
If access is not available within 30 minutes of arrival, the appointment may be considered a cancellation, and a cancellation fee may apply.
If a return visit is required due to access issues, a reshoot fee may be charged.
Property Readiness
Clients are responsible for ensuring the property is fully prepared and ready prior to the appointment. A preparation checklist may be provided.
Blue Indigo Creative is not responsible for cleaning, staging, or preparing the property.
Media will reflect the condition of the property at the time of the shoot. Blue Indigo Creative is not responsible for correcting or editing items present at the time of capture.
Blue Indigo Creative is not responsible for securing the property after the session, including locking doors or turning off lights, appliances, or other systems.
Travel & Parking
Travel is included within a 50-mile radius. Additional mileage will be billed at $1.00 per mile.
Any required parking fees will be billed to the client.
Payment
Invoices are issued at the time of booking. Payment is due prior to media delivery unless otherwise agreed in writing.
Blue Indigo Creative reserves the right to withhold delivery until payment is received in full.
Payments are non-refundable once services are scheduled.
Canceled sessions may be applied as a credit for up to 12 months, subject to the cancellation policy.
Cancellation Policy
A minimum of 24 hours’ notice is required for cancellations or rescheduling.
Appointments canceled with less than 24 hours’ notice or no-shows may incur a $100 cancellation fee.
If a revisit is required due to property readiness, access issues, or changes outside the original scope, a $150 return fee may apply.
Weather Conditions
Outdoor photography and drone services are weather-dependent.
Blue Indigo Creative reserves the right to reschedule services due to unsafe or unsuitable conditions, including rain, wind, or heavy cloud cover.
Drone Operations
All drone operations are conducted by FAA-licensed pilots and are subject to FAA regulations and airspace restrictions.
Drone services may be canceled or rescheduled due to safety, legal, or environmental conditions. No refunds will be issued for conditions outside of our control.
Twilight Photography
Twilight sessions are time-sensitive and dependent on sunset conditions.
If the property is not ready at the scheduled time, the twilight portion may be forfeited, and a reshoot fee may apply.
Delivery Timeline
Photography is typically delivered within 48 hours.
Video and social media content are delivered within 5 to 7 business days.
Delivery times may vary based on workload, holidays, or project complexity.
Media is delivered via a downloadable gallery or a file-sharing platform.
Revisions & Editing
Standard editing is included. Additional editing, including object removal or custom requests, may incur additional fees.
File Storage
Media files are stored for approximately 30 days after delivery. Clients are responsible for downloading and backing up their files.
Blue Indigo Creative is not responsible for file loss after this period.
Usage Rights
Blue Indigo Creative retains full copyright ownership of all media.
Clients are granted a limited, non-transferable license to use the media solely for marketing the specific property associated with the original listing.
Media may not be reused, resold, or transferred without written permission.
If a property is relisted, a new license must be purchased.
MLS Compliance
While media is delivered with quality standards in mind, it is the client’s responsibility to ensure compliance with local MLS rules and regulations.
Floor Plans & Measurements
Floor plans are provided for visual marketing purposes only and are not guaranteed to be exact.
All dimensions and layouts are approximate and may contain errors or omissions. Floor plans should not be relied upon for architectural, engineering, appraisal, or legal purposes.
Clients and third parties are responsible for independently verifying all measurements and property details.
Blue Indigo Creative shall not be held liable for any inaccuracies, discrepancies, or damages arising from the use of floor plans or measurements.
Use of the floor plan constitutes acceptance of these limitations.
All measurements are approximate and not guaranteed.
Social Media Content
Social media content is optimized for platform performance; however, Blue Indigo Creative does not guarantee engagement, reach, or results.
Promotional Use
Blue Indigo Creative reserves the right to use all media for portfolio, website, social media, advertising, and promotional purposes.
Clients will not receive compensation for promotional use.
Confidentiality
Blue Indigo Creative respects the confidentiality of all clients.
Any non-public information, including property details, pricing, marketing strategies, or access instructions, will not be shared with any third party without written consent.
This includes any personal or professional relationships, including real estate agents, brokers, or affiliated parties.
Confidential information will only be used for the purpose of providing services and will not be used for personal gain.
This obligation remains in effect after the completion of services.
Liability
Blue Indigo Creative reserves the right to refuse service if conditions are unsafe.
Blue Indigo Creative is not responsible for any injury, damage, or loss occurring at the property during the session.
To the fullest extent permitted by North Carolina law, Blue Indigo Creative’s total liability for any claim, loss, or damage arising out of or related to services provided shall not exceed the total amount paid by the client for those services.
Force Majeure
Blue Indigo Creative shall not be held liable for delays or failure to perform due to events beyond our control, including but not limited to weather, natural disasters, government restrictions, or power outages.
By booking services, submitting payment, or selecting the agreement checkbox on an invoice, the client acknowledges that they have read, understood, and agree to these Terms and Conditions.
These Terms shall be governed by and interpreted in accordance with the laws of the State of North Carolina.
